San Marcos DUI Defense Attorney

A DUI arrest along the SR-78 corridor, near California State University San Marcos, or on San Marcos Boulevard launches two parallel fights you have to manage at the same time: the criminal case waiting at the North County courthouse in Vista, and a DMV action that will suspend your license unless a hearing is requested within 10 days of the arrest. Ron Chini is an experienced DUI defense attorney who handles San Marcos and North County DUI cases from his Irvine office, and he can step in on both fronts right away.

San Marcos is the educational hub of San Diego's North County — home to California State University San Marcos and Palomar College — wrapped around the SR-78 freeway between Escondido and Vista, with Old California Restaurant Row on San Marcos Boulevard and the golf-and-lake community of Lake San Marcos to the south. That mix of a large student population, a busy restaurant corridor, and fast freeway access shapes how DUI enforcement plays out here, and it shapes the defense, too.

How DUIs are policed in San Marcos

San Marcos does not have its own municipal police department. The city contracts its law enforcement to the San Diego County Sheriff's Department, which operates the San Marcos Sheriff's Station as part of the city's Public Safety Center. Sheriff's deputies handle patrol and general calls for service throughout San Marcos and the surrounding unincorporated communities, and they run the city's local DUI enforcement — including publicized DUI/driver's license checkpoints and roving DUI saturation patrols, which are typically supported by grant funding from the California Office of Traffic Safety (OTS). When you read that a "San Marcos DUI checkpoint" is planned, it is Sheriff's deputies working it.

San Marcos's OTS traffic-safety profile generally reflects a mid-sized North County city — its alcohol-involved-collision and DUI-arrest measures have historically landed in the middle-to-lower range relative to comparable California agencies, rather than at the top of the list (DRAFT — verify current-year OTS figures at ots.ca.gov before relying on any specific rank or count). Even in a city without an outsized DUI ranking, a college town with a dense restaurant row tends to see consistent enforcement around the bars, campus events, and weekend nights.

The freeways are a different jurisdiction. The California Highway Patrol (CHP) Oceanside Area office patrols the North County freeways serving San Marcos — including SR-78 and Interstate 15 — so a stop on the highway is usually a CHP matter, while a stop on a city street is usually the Sheriff's. The arresting agency affects which reports, dashcam, and bodycam footage exist, and a careful defense starts by pulling all of it.

Who prosecutes a San Marcos DUI — and where

San Marcos has no city prosecutor. The only San Diego County city that prosecutes its own misdemeanor DUIs is the City of San Diego, through its City Attorney. For San Marcos, both misdemeanor and felony DUI cases are prosecuted by the San Diego County District Attorney — specifically the DA's North County Branch (DRAFT — confirm against sdcda.org).

A San Marcos DUI is filed and heard at the North County Regional Center in Vista — the San Diego Superior Court location that serves the North County, just a short drive from San Marcos. That is where arraignments, hearings, and any trial take place. Ron Chini handles San Marcos cases from his Irvine office and appears in the San Diego Superior Court; he does not maintain a San Marcos office. See our North County (Vista) courthouse guide for how DUI cases move through that court.

Who prosecutes a DUI in San Marcos?

The San Diego County District Attorney prosecutes both misdemeanor and felony DUI cases arising in San Marcos — there is no San Marcos city prosecutor. (In San Diego County, only the City of San Diego prosecutes its own misdemeanor DUIs, through its City Attorney; every other city, including San Marcos, goes to the County DA.) San Marcos cases are generally handled by the DA's North County Branch (DRAFT — verify at sdcda.org).

Which courthouse will my San Marcos DUI go to?

The North County Regional Center in Vista — the San Diego Superior Court location serving North County. Your arraignment, hearings, and any trial happen there. See our North County (Vista) courthouse guide.

Who arrested me — the police or the Sheriff?

San Marcos contracts its policing to the San Diego County Sheriff's Department, so a stop on a city street is almost always made by Sheriff's deputies from the San Marcos Station, and local DUI checkpoints are run by the Sheriff. If you were pulled over on SR-78 or I-15, it was likely the CHP Oceanside Area office. Knowing the agency tells us which reports and bodycam/dashcam footage to request.

I was just arrested in San Marcos — what do I do about my license?

Act fast. You generally have only 10 days from the date of your DUI arrest to request a DMV hearing, or your license is scheduled to suspend automatically — this is separate from your court case in Vista. Requesting the hearing in time can also keep you driving while the case is pending. Call us right away so we can request it for you. See the 10-day DMV deadline.
