How DUIs are policed in Montclair
Unlike several of its West Valley neighbors, Montclair runs its own police force rather than contracting with the Sheriff. The Montclair Police Department traces back to the city's April 25, 1956 incorporation, when it started with just six sworn officers working out of a 17-by-8-foot office. It has since grown into a full department organized into Administrative, Support Services, and Field Services divisions — the city's own current staffing figures range from 57 to roughly 60 sworn officers depending on which page you check, so treat "about 60" as an approximation rather than an exact headcount. Montclair joins Chino, Fontana, Ontario, Upland, and Rialto as West Valley cities that each field their own department, while Chino Hills and Rancho Cucamonga instead contract with the San Bernardino County Sheriff's Department for police service.
Interstate 10 (the San Bernardino Freeway) runs through the northern part of Montclair's 5.53 square miles, and the Montclair Police Department has a history of running periodic DUI/driver's-license checkpoints, including California Office of Traffic Safety grant-funded operations timed to holiday weekends. The California Highway Patrol handles DUI enforcement on the I-10 segment itself, while Montclair officers patrol the city's surface streets, including the commercial corridors around Central Avenue, Holt Boulevard, and Monte Vista Avenue.
- Montclair's 2023 OTS traffic-safety data shows a pattern worth knowing: the city ranked just 85th of 93 comparably sized agencies for raw DUI arrest counts (170 arrests), yet ranked 1st of 93 for alcohol-involved collision victims (55) and 4th of 93 for total fatal-and-injury victims (332) — a high-collision, lower-arrest profile, not an explanation of why.
- The city's compact footprint — 5.53 square miles bordered by Pomona and Claremont (both in Los Angeles County) to the west, Upland to the north, Ontario to the east, and Chino to the south — means a short drive in almost any direction crosses both a city line and sometimes a county line, which can matter for where an arrest report gets written up.
Where a Montclair DUI case is heard
A DUI arrest anywhere in Montclair is filed at the Rancho Cucamonga District courthouse, 8303 Haven Avenue, Rancho Cucamonga, CA 91730 — Montclair is named directly on that courthouse's own "Areas Served" list, alongside Rancho Cucamonga, Ontario, Upland, Chino, Chino Hills, Fontana, Rialto, and Bloomington. The San Bernardino County District Attorney's Office prosecutes the case; Montclair does not use a city attorney for misdemeanor DUI prosecution, even though it runs its own police department. Rancho Cucamonga is a dedicated criminal courthouse, so a misdemeanor DUI and a felony-level DUI (for example, one involving injury) are both handled at the same Haven Avenue building rather than being split across two courthouses.

Booking and getting a car back after a Montclair arrest
Montclair PD's own station is the intake point for a DUI arrest, but it is not where someone stays in custody. For West Valley cities, including Montclair, the county's standard booking destination is the West Valley Detention Center, 9500 Etiwanda Avenue, Rancho Cucamonga — run by the San Bernardino County Sheriff's Department and used as the intake facility for arrests made by agencies across the West Valley, not Montclair PD alone. Whether someone is released on their own recognizance, posts bail, or waits for an initial court appearance depends on the specifics of the arrest. Family members trying to locate a Montclair arrestee can call our office for help.
Your car is a separate matter from the arrest itself. A routine tow after a DUI arrest usually lets you (or someone you authorize) retrieve the vehicle from the tow yard once you handle the release paperwork, towing fee, and storage fee — that's an ordinary Vehicle Code §22651(h) tow. A mandatory 30-day impound under Vehicle Code §14602.6 is a different, more serious outcome that only applies when the driver was also operating on a suspended or revoked license, on a restricted license without a required interlock device, or without ever having been issued a license — not for a DUI arrest by itself. From Monte Vista to Montclair: a short history and the city's two landmarks
Long before any city existed here, the Serrano people maintained a village along a sycamore-lined creek running through what is now Montclair. The area's first modern name came in 1897 as "The Township of Marquette," and by 1900 a 1,000-acre tract inside that township had been surveyed and renamed Monte Vista. It stayed citrus country — orange and lemon groves — through the early 20th century, until rapid postwar residential and commercial growth replaced most of the orchards. The city incorporated under that tract's name, Monte Vista, on April 25, 1956, then changed its name to Montclair less than two years later, on April 8, 1958, after persistent mail and record-keeping confusion with an unrelated Northern California community also called Montclair. The Civic Center was later dedicated on April 25, 1964 — the eighth anniversary of incorporation to the day.
Montclair's commercial identity now centers on two landmarks a few blocks apart. Montclair Place (opened in 1968 as Montclair Plaza, expanded with a second level in 1985, and substantially renovated after CIM Group bought the mall for roughly $170 million in 2014 and rebranded it in November 2015) anchors the retail core with department stores, a multiplex theater, and dining. A few blocks north, the Montclair Transit Center, 5091 Richton Street, opened February 22, 1993 and today runs roughly 32 weekday Metrolink San Bernardino Line trains (16 each direction), plus Omnitrans bus connections — making Montclair, despite its small footprint, a genuine transit hub for commuters across the West End.
