Brea's own name is a clue to its origin: "brea" is the Spanish word for tar or pitch, and the city grew up around the Brea-Olinda Oil Field that the Union Oil Company began developing in the late 1890s on land it bought from the old Olinda rancho. Oil derricks, not freeways, built the place — Brea incorporated in February 1917 as Orange County's eighth city, with a population of just 752. A century later the oil wells are mostly gone, and the identity has shifted to Downtown Brea, a walkable shopping-and-nightlife district on Birch Street and Brea Boulevard, and the Brea Mall just off State Route 57 — two real local draws that, along with the 57 itself, shape where and when DUI arrests happen in this city. If you were arrested for DUI anywhere in Brea, Ron Chini defends the case from his Irvine office, working directly with you by phone, email, and video.

Where a Brea DUI case is heard

A DUI arrest in Brea is filed at the Superior Court's North Justice Center in neighboring Fullerton. The court's own location page lists Brea as one of eight cities that building serves — the others are Anaheim, Buena Park, Fullerton, La Habra, La Palma, Placentia, and Yorba Linda. For the courthouse address, parking, and courtroom basics, see our North Justice Center guide. The Orange County District Attorney's Office — not a Brea city attorney — decides what to charge and prosecutes the case, the same as everywhere else in the county. A charge raised to felony level is the one exception: the court's own page says the Central Justice Center in Santa Ana hears felony matters for all Orange County cities, so check your arraignment paperwork for the courthouse actually named on it.

Brea's own police department — and the freeway question

Brea runs its own full-service police department, headquartered at 1 Civic Center Circle — it is not one of the 13 Orange County cities that contracts with the Orange County Sheriff's Department for patrol (that list is Aliso Viejo, Dana Point, Laguna Hills, Laguna Niguel, Laguna Woods, Lake Forest, Mission Viejo, Rancho Santa Margarita, San Clemente, San Juan Capistrano, Stanton, Villa Park, and Yorba Linda). In fact, the relationship used to run the other direction: until 2013, Brea PD itself held the contract to police neighboring Yorba Linda, before the Orange County Sheriff's Department won that contract away — 19 of the 26 deputies OCSD assigned to Yorba Linda at the time came over from Brea PD. A DUI arrest made on a Brea street — Birch Street, Imperial Highway, State College Boulevard — is typically a Brea PD case from the first stop through the first court date.

The freeways raise a separate question. State Route 57 runs the length of the city, crossing Imperial Highway (State Route 90) near Brea Mall before climbing into Brea Canyon toward the Los Angeles County line — a route that did not exist until SR-57 was extended through Brea in the 1970s, the same decade the mall opened. The California Highway Patrol, not Brea PD, generally handles DUI enforcement on the freeway itself. The CHP's Santa Ana Area office — whose own published freeway list covers Interstate 5, Interstate 405, and State Routes 55, 22, and 91 — is confirmed to patrol SR-57 only near the "Orange Crush" interchange well south of Brea, so which CHP unit actually covers the Brea stretch of the 57 was not independently confirmed for this page. If your stop happened on the freeway rather than a city street, check your citation for the arresting agency, since that can change where your paperwork and your vehicle ended up.

Was your car towed — or impounded for 30 days?

Most DUI-related tows are routine: under Vehicle Code §22651(h), an officer can have a vehicle towed simply because its driver was arrested or served a license-suspension notice, and the car is typically released once a licensed driver claims it and pays towing and storage fees. That is different from a 30-day impound under §14602.6, which applies only when the driver was unlicensed or already suspended or revoked at the time of the stop — not to a standard DUI stop where the driver still holds a valid license. If your car was held under §14602.6, ask about an early-release administrative hearing right away.

Brea Mall, Downtown Brea, and the 57 corridor

Brea Mall is one of the larger regional malls in Orange County — about 1.28 million square feet of leasable space, more than 180 stores, and roughly 14 million visitors a year, right off the SR-57/Imperial Highway interchange. A few minutes away, Downtown Brea — the roughly 50-acre shopping-and-entertainment district on Birch Street and Brea Boulevard that replaced an aging retail strip when it opened in 2000 — packs 22 movie screens, an Improv comedy club, and a walkable grid of restaurants and bars into a few blocks that stay busy from lunch through late evening. Two major traffic generators within a short drive of each other, both feeding onto the same SR-57 corridor, is exactly the kind of pattern that concentrates evening and weekend DUI enforcement.

Where will my Brea DUI case be heard?
At the North Justice Center, 1275 North Berkeley Avenue, Fullerton — the courthouse the Orange County Superior Court designates for Brea, Anaheim, Buena Park, Fullerton, La Habra, La Palma, Placentia, and Yorba Linda. The Orange County District Attorney, not a Brea city attorney, prosecutes the case.
Does Brea have its own police department, or does the Sheriff patrol it?
Brea runs its own full-service police department, headquartered at 1 Civic Center Circle. Brea is not one of the 13 Orange County cities that contracts with the Orange County Sheriff's Department for patrol — in fact, until 2013 Brea PD held the opposite role, contracting to police neighboring Yorba Linda before OCSD won that contract.
I was pulled over on SR-57 instead of a city street — does my case still go to the North Justice Center?
For a misdemeanor DUI, yes — the North Justice Center still hears the case regardless of whether Brea PD or the California Highway Patrol made the stop on the freeway. Confirm the arresting agency named on your citation, since that can affect where your vehicle was towed and which department holds your paperwork.
Was my car impounded for 30 days, or just towed?
Only if you were driving on a suspended or revoked license, or without a license at all, does California law (Vehicle Code §14602.6) allow a 30-day impound. A standard DUI tow under §22651(h) is released once a licensed driver claims it and pays towing and storage fees — ask your attorney which applies to your stop.
